California Proposition 65

California Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires certain businesses to provide warnings before knowingly and intentionally exposing individuals in California to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

Small-Business Exemption

California Health and Safety Code section 25249.11(b) excludes a business employing fewer than ten employees from the definition of a “person in the course of doing business” for purposes of Proposition 65.

To the extent Dave Fant Company of Arkansas Inc. qualifies for this small-business exemption, it is not independently required to provide Proposition 65 warnings.

Manufacturer and Supplier Warnings

Manufacturers, suppliers, distributors, marketplaces, or other parties may provide Proposition 65 warnings, labels, or notices for particular products. When such a warning is supplied to us or accompanies a product, we may reproduce, display, or pass along that warning to customers.

Any Proposition 65 warning provided with a product should not be removed, concealed, altered, or disregarded.

No Product-Specific Representation

The presence or absence of a Proposition 65 warning on our Sites, on a product page, at checkout, on product packaging, or with a shipment is not a representation or warranty by Dave Fant Company of Arkansas Inc. that a product does or does not contain a Proposition 65-listed chemical, that an exposure does or does not occur, or that any particular exposure is safe or unsafe.

We do not independently test each product for every chemical appearing on California's Proposition 65 list.
