California Proposition 65

California Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires certain businesses to provide warnings to California consumers about significant exposures to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.
California Health and Safety Code section 25249.11(b) excludes a business employing fewer than ten employees from the definition of a “person in the course of doing business.” To the extent Dave Fant Company of Arkansas Inc. qualifies for this exclusion, it is not independently required to provide Proposition 65 warnings.
Nevertheless, when a manufacturer, supplier, distributor, marketplace, or other responsible party provides a Proposition 65 warning, label, or notice for a product, we may reproduce or display that warning. Customers must not remove, conceal, alter, or disregard any warning accompanying a product.
The presence or absence of a warning on our Sites, at checkout, on a product page, or with a product is not a representation or warranty by Seller that a product does or does not contain a Proposition 65-listed chemical or that any particular exposure is safe or unsafe.
